Are you eligible for veterans’ benefits for non-service related disabilities?

The Veteran Benefit Lawyers of Shields & Boris can help you pursue your right to benefits or appeal.

One of the biggest fears many people have today is the fear of having their life savings wiped out if they have to pay for substantial medical and health care expenses.  Even paying for home health care or an assisted living facility can wipe out someone’s life savings.  Whether you or a family member is in crisis or not, it is important that you understand what you can do to protect your hard earned assets! The Veterans Administration has numerous programs for disabled and elderly veterans.  Some of these programs offer VA benefits in addition to Medicaid benefits.  Most veterans or their surviving spouses are not aware of these benefits.  A vet who is over 65 and now disabled may qualify for much needed money to pay for medical bills!

If you believe that you or a loved one may qualify for this benefit please contact us today to schedule a free consultation,

What Types of VA Benefits are Available?
VA benefits can come in a variety of forms to include medical benefits, nursing home care and the often overlooked “aid and attendance”.

Medical Benefits are provided in a health benefits plan available to enrolled veterans.  Due to budgetary constraints these benefits are delivered based on a priority system.  Once enrolled veterans are assigned to priority groups, which determine the types of services they may access.  These benefits include prescription drugs, home health services and hospice care.  If a veteran or the surviving spouse qualifies for this non-service related disability pension, you may automatically receive free prescriptions.

Nursing Home Care can be paid for with this VA benefit, allowing the veteran to hold onto his or her assets for as long as possible.  Even if the veteran is eligible for Medicaid, the benefit will provide an additional $90 a month in discretionary income.

Aid and Attendance can be an excellent benefit for long-term care for the elderly, either at home,  in an assisted living facility or in a long-term care facility.  This benefit is available to certain wartime veterans and their dependents that meet specific criteria.  Aid and Attendance benefit amounts will vary based on their out of pocket medical expenses and monthly income.

What if I have non-service related condition?
Under a rule adopted in 2002, the VA will grant a priority level to “severely disabled” veterans even if their immediate health problem is not a service related injury.   Aid and Attendance benefits are available to veterans who are totally disabled because of non-service related conditions.  It is also available to their spouse or their surviving spouse.   Additional criteria are required for these benefits.  The attorneys at Shields & Boris can help you explore your rights to these and other benefits.

Where do I go to find a veteran benefit lawyer?
