If you have capacity when you enter a hospital, you can sign a HIPAA release that authorizes to whom the doctor can talk to on your behalf. But what if you enter the hospital unconsious and cannot sign a HIPAA release? The reasson you have to sign a release is because a doctor and/or hospital are both civilly and criminally liable if they release your medical information to the wrong person. This makes doctors very cautious about putting anything about your medical condition in writing.
So if you have a financial power of attorney that is only effective when two doctors put in writing that you are incapacitated and doctors are unwilling to put in writing that you are incapacitated, your power of attorney is useless.
