Q: Will a living trust make me ineligible for Medicaid?

A: Setting up a living trust can be a great idea, but you must proceed with caution to make sure you don’t compromise your ability to receive Medicaid benefits.  For example, you can become ineligible for Medicaid if you create a trust that names you or your spouse as a beneficiary.

The problem with naming you or your spouse as a beneficiary is that the government will assume that the assets in your trust are available to pay for your nursing home care if the trust was created within 5 years of when you apply for Medicaid.
