Q: When we find out that a loved one is entering towards the end of life, what needs to be determined first?

A: The first thing that we have to do is find out who is in charge.  We need to see if the individual that is nearing the end has the appropriate legal documents in place, such as the power of attorney for finance, power of attorney for health care, living wills, HIPPA authorization and releases.  These documents are very important, because these are the documents that help control the estate while that individual still alive, but either incapacitated or incompetent. 

These documents should be given to all of the ill persons financial institutions and health care providers.  This way, the person in charge can find out if there is any problem with using these power of attorneys as soon as possible.
