Q: What is probate property?

A: You may be wondering what types of property must go through probate.  Only certain types are required to go through probate and are known as “probate property”.  These include:
• Property you hold in your name alone
• Property you hold jointly as “tenants in common”
• Life insurance policies that are payable to your estate as opposed to another person or institution

Other types of property do not have to go through probate.  The properties below can be disbursed directly to your beneficiaries and heirs:
• Property that you own jointly with right of survivorship
• Property in a trust
• Assets that have a named beneficiary
• 401(k) assets
• Pension
• Life insurance
• Annuities
